TERMS OF SERVICE AND CONDITIONS OF USAGE

INTRODUCTION
PlusTest app is operated by PLUS GAMES ("the Company", "us", "we" or "our"), a limited liability company registered in Grenoble, France.

Please read these Terms of Service and our Privacy Policy (https://plus-games.com/plus-test-privacy) (collectively, the "Agreement") carefully before using PlusTest, or other products, services, and/or content provided by PLUS GAMES. (all of those collectively, the "Services"). By using or accessing the Services, you ("Subscriber" or "you") agree to become bound by all the terms and conditions of this Agreement. If you do not agree to all the terms and conditions of this Agreement, you shouldn't and aren't permitted to use the Services. By accessing and utilizing the Services, you indicate that you have read and agree to abide by these Terms of Service ("Terms").

Collection and Use of Your Data
By using PlusTest, I acknowledge and agree that PLUS GAMES may collect the following personal data:

• Installed apps (including usage duration and history)
• Registration data (age, gender, email address, IP address, GAID, phone number)

This data is associated with your device through the device ID (GAID or IDFA), transmitted to our servers in encrypted form. To facilitate billing for app providers supporting our app proposals, your device ID must be shared with them. Users may voluntarily upload screenshots from their mobile phones via PlusTest to measure usage time and installed apps. These screenshots are automatically processed, evaluated, and stored in our system for membership purposes.

These Terms establish a legal agreement between you and PLUS GAMES, applicable globally to all users of our Services on the App and Website. They contain terms and conditions affecting your rights, obligations, and remedies in connection with the use of our App and Website Services. Among other things, you are obligated to:

• Comply with all applicable laws and regulations.
• Acknowledge that we bear no liability to you.
• Understand that you cannot pursue claims against us, either individually or as part of any class or representative action.

By using the Services, you agree to adhere to and comply with all applicable terms outlined in these Terms. If you disagree with these Terms, kindly discontinue using PLUS GAMES Services immediately. Failure to comply with these Terms may result in suspension from using the Services, with civil and criminal penalties enforceable against you.

ELIGIBILITY
The Services are exclusively offered to individuals aged 18 and above. The App is not a substitute for employment, and users are solely responsible for their actions on and around the App and Website.

USER CONDUCT
Users agree not to engage in activities that interfere with or disrupt the Services. Users may not:

• Access, copy, store, or use any aspect of the App, Website, or Services for any purpose other than personal use.
• Distribute, disclose, publish, sell, rent, or otherwise expose any aspect of the Services to third parties.
• Prepare derivative access points for our Services.
• Circumvent our systems, policies, or given suspensions.
• Access the Services other than through the currently available, published interfaces provided by PLUS GAMES, namely the App and Website.
• Mirror or frame any page, feature, or functionality of the Services.
• Abuse the Services or breach the Terms.
• Attempt to do any of the foregoing, or instruct any third party to do so.

UPDATES TO TERMS
PLUS GAMES reserves the right to update the Terms at any time without prior notice. Updates may include changes, modifications, additions, removals, or other updates to the Terms ("Update"). If we choose to update the Terms, we will revise the "Last Updated" date at the bottom of the Terms and post the updated version. Users will not receive individual notifications for Updates.
By continuing to use the Services after we post an updated version of the Terms, you agree to be bound by the updated Terms. If the updated Terms are unacceptable to you, please cease using the Services immediately.

INTELLECTUAL PROPERTY
Users acknowledge that PLUS GAMES's Services have been meticulously developed with substantial time, effort, and financial resources. Consequently, the Services of our App and Website display valuable intellectual property and trade secrets of PLUS GAMES.
In the event of an intellectual property breach, PLUS GAMES reserves the right to enforce intellectual property rights to the fullest extent permitted by law.
Users are encouraged to provide feedback in the form of ideas and suggestions for improving the Services ("Feedback"). Feedback can be submitted via email to [email protected]. PLUS GAMES may proactively request and select user feedback through the App, Website, or email. Users acknowledge that feedback is non-confidential and immediately becomes the sole and exclusive property of PLUS GAMES. Users irrevocably transfer and assign to PLUS GAMES all their right, title, and interest in and to all Feedback.

WARRANTIES, DISCLAIMERS, LIMITATION OF LIABILITY & INDEMNIFICATION
Warranties by Users when using PlusTest:

• You have the power and authority to acknowledge and agree to these Terms.
• You own or control all the rights necessary to provide the information and grant the rights and licenses granted herein.
• You will not violate any applicable laws, rules, or regulations when using PlusTest.
• You will not cause PLUS GAMES to violate any applicable laws, rules, or regulations or infringe the rights of any third party.
• You will provide complete, accurate, and up-to-date account information.

Disclaimer:
Except as expressly provided herein, the Services are provided "as is" and "as available" without warranty of any kind, express or implied.
PLUS GAMES assumes no liability or responsibility for the accuracy of the Services in the App or Website or the content of any sites linked to our Services. Customer claims for damages are excluded. Users may request a payout to their PayPal account after completing one or multiple surveys. The payout threshold may be adjusted by PLUS GAMES. After providing PayPal account details, PLUS GAMES sends a money transfer to the user's PayPal account. PLUS GAMES may, in its sole discretion, adjust or cancel the payout request without further reasoning. We may also decide to terminate the legal agreement and deny further usage of the App or Website for any user, including the deletion of any remaining claims.
To the maximum extent possible under applicable law, you agree to release, indemnify, and hold PLUS GAMES, its affiliates, and service providers, as well as their officers, directors, shareholders, agents, employees, and representatives, harmless from and against any claims, liabilities, damages, losses, costs and expenses, including tax matters, legal fees, and litigation expenses and costs, arising out of or relating to or in any way connected with your use of the Services. You acknowledge that your earnings on PLUS GAMES's App and Website may be considered reportable and taxable earnings in your jurisdiction.

RULES
For successful coins accrual or monetary payout through PlusTest, users must adhere to the instructions provided with each survey or game and reach the minimum coins amount. A minimum of 75 coins is required to qualify for a payout. Payout amounts are unlimited. The loyalty program rewards users in strict accordance with the Google Play Developer Program Policy Update, effective March 1, 2021.

YOU MUST NOT:
Use this Platform in any way that causes, or may cause, damage to PlusTest or impairment of the availability or accessibility of www.plus-games.com or in any way which is unlawful, illegal, fraudulent or harmful, or in connection with any unlawful, illegal, fraudulent or harmful purpose or activity. This includes but is not limited to the following actions:

* Republish material from PlusTest in print or digital media or documents (including republication on another platform or website). This includes the taking of screenshots, audio/video recordings or streaming content from PlusTest
* Sell, rent, trade or sub-license material from PlusTest
* Show any material from PlusTest in public
* Reproduce, duplicate, copy or otherwise exploit material on this website for a commercial purpose
* Edit or otherwise modify any material on the PlusTest
* Transfer, distribute or permit the use of any PlusTest materials to any third party
* Make copies of any PlusTest materials
* Reverse engineer, decompile or disassemble PlusTest materials
* Discuss any material from PlusTest on any social media channel or public forum
* Redistribute material from PlusTest - except for content specifically and expressly made available for redistribution
* Republish or reproduce any part of PlusTest through the use of iframes or screenscrapers
* Utilize any PlusTest materials to create other computer programs for any reason.
* Create more than a single PlusTest account per person.
* Intentionally mask or alter your IP address, including the use of a VPN.
* Involve any AI-powered, text-generating software while composing your feedback (this does not include typing assistant software such as Grammarly).

The privacy policy may be adjusted, changed, or updated at any time. If you do not agree to the privacy policy, please stop using PLUS GAMES Services immediately.

GOVERNING LAW
These Terms shall be governed by the law of France.
